Notice of Interim Measures for Announcement

All provinces, autonomous regions, and municipalities, such as the Development and Reform Commission, the Economic and Trade Commission (ECO), the Supervision Department, the Department of Finance, the Construction Department, the Railway Bureau, the Communications Department, the Communications Administration, the Information Industry Department, the Water Resources Department, the Department of Commerce, the Civil Aviation Administration, and the Legislative Affairs Office:
In order to implement the "Several Opinions of the General Office of the State Council on Further Regulating Tendering and Bidding Activities" (Guobanfa [2004] No.56), promote the construction of the tendering and tendering credit system, improve the mechanism for punishing dishonesty in tenders and tenders, standardize the behaviors of the parties involved in bidding and tendering, and tendering and tendering department. Each member unit of the inter- national coordination mechanism decided to establish a system for publicizing the unlawful behaviors of bid invitations and bids, and to jointly formulate the “Provisional Measures for the Announcement of Records of Illegal Conduct in Tendering and Bidding” (hereinafter referred to as “Provisional Measures”), which are hereby issued and issued. To effectively implement the "Provisional Measures," we hereby notify the following matters and requirements:
I. Do a good job in the preparations for the implementation of the "Provisional Measures." The establishment of an announcement and record system for bidding violations is an important measure and an effective method for establishing a credit system in the bidding and tendering market. All localities must pay close attention to the requirements of the "Provisional Measures" to establish a platform for the publication of unlawful bidding records for the administrative region; those that have already been established should be further standardized and improved in accordance with the Provisional Measures.
Second, strict implementation of "provisional regulations" provisions. Each provincial administrative department shall issue an announcement in accordance with the type of announcement, content of the announcement, deadline for announcement, and relevant procedures as stipulated in the Interim Measures to ensure that the announcement is accurate, timely, and objective. The decision on the administrative processing of the illegal acts of tendering and bidding announced by the relevant administrative department at the provincial level shall be copied to the competent administrative department of the State Council as required.
3. The problems encountered by the provincial competent administrative departments in the announcement shall be promptly reported to the competent administrative department of the State Council.
